1. Acceptance of Terms
By accessing or using Chatea (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Chatea is an AI-powered CRM platform that enables businesses to manage WhatsApp, Instagram, and Facebook Messenger conversations. The Service includes:
- Multi-channel conversation management.
- AI-powered automatic responses.
- Contact and tag management.
- WhatsApp message templates.
- Message scheduling.
- Statistics and reports.
- Multi-agent team management.
3. User Account
- You must provide accurate information when creating your account.
- You are responsible for maintaining the security of your account and password.
- You must notify us immediately of any unauthorized use.
- One account per person/organization, unless explicitly authorized.
4. Acceptable Use
By using the Service, you agree to:
- Comply with WhatsApp Business, Instagram, and Facebook policies.
- Not send spam or unsolicited messages.
- Not use the service for illegal activities.
- Not attempt to access other users’ accounts.
- Not reverse-engineer the Service.
- Obtain necessary consent from contacts before sending them messages.
5. Plans and Payments
- Free Plan: includes basic features with usage limits.
- Paid plans: offer additional features based on the selected plan.
- Payments are processed securely through our payment providers.
- You can cancel your subscription at any time. Access continues until the end of the paid period.
- We do not offer refunds for partial periods.
6. Intellectual Property
The Service, including its code, design, logos, and content, is the property of Chatea. Your data and content remain your property.
7. Artificial Intelligence
- AI-generated responses are automatic suggestions and do not constitute professional advice.
- You are responsible for reviewing and approving messages sent to your customers.
- Messages processed by AI are sent to third-party AI providers (Google Gemini) for processing.
8. Service Availability
We strive to keep the Service available 24/7, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance with prior notice.
9. Limitation of Liability
Chatea is provided “as is.” We are not responsible for:
- Data loss caused by third-party failures (WhatsApp, Meta, etc.).
- WhatsApp or other platform service interruptions.
- Decisions made based on AI responses.
- Indirect, incidental, or consequential damages.
10. Termination
We may suspend or terminate your access to the Service if:
- You violate these Terms of Service.
- You use the Service fraudulently or illegally.
- You fail to pay applicable fees.
Upon termination, your data will be retained for 30 days to allow export, then deleted.
11. Changes to Terms
We may modify these terms at any time. We will notify you of significant changes at least 15 days in advance. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These terms are governed by the laws of the United Mexican States. Any dispute will be resolved in the competent courts of Mexico City.
